Employment of Foreign Nationals in Slovakia
-
An EU citizen can be employed in the Slovak Republic without the need to obtain a work or other permit.
If an EU citizen registers his/her residence on the territory of the Slovak Republic on the basis of employment in Slovakia, he/she may attach to his/her application for registration of residence with the respective Foreign Police Department an employment contract, a promise from the employer or a confirmation of employment from the employer.
-
If you want to work in Slovakia and you are not a European Union national, you have to meet different conditions depending on the type of residence, type of work you want to perform, length of stay and other factors.
In general a third-country national may be employed in Slovakia if he/she:
- is an EU Blue Card holder,
- was granted temporary residence for the purpose of employment on the basis of the confirmation on the possibility to fill in a vacancy – so-called single permit,
- was granted a work permit and temporary residence for the purpose of employment,
- was granted a work permit and temporary residence for the purpose of family reunion within the first 9 months from being granted the residence,
- was granted a work permit and temporary residence for the purpose of a third-country national with acknowledged long-term residence in another EU Member State within the first 12 months from being granted the residence, or
- meets the conditions under which he/she does not need the confirmation on the possibility to fill in a vacancy nor the work permit to become employed.
If you need a work permit, confirmation on the possibility to fill in a vacancy or if you hold the EU Blue Card, you are only entitled to perform work within an employment relationship (contract of employment). In other cases, you may also be employed on the basis of an agreement performed out of the employment relationship. If you should be employed as a pedagogic employee, university teacher, researcher or artist at a higher education institution, or research or development staff for educational or research activities, the labour market situation is NOT taken into account. However, with effect from 1 January 2019 your employer must report a vacancy to a competent Labour Office via the online system ISTP. There is NO TIME LIMIT to do so and you can apply for a temporary residence immediately by completing the Temporary residence application form.
In this case the Labour Office will issue a confirmation of the possibility to fill a vacant position without taking into account the situation on the labour market.
